Article 1. Application of these general conditions of sale

These conditions apply to the sale of products by VEGETAL SHOP on its shop accessible by Internet www.vegetal.shop. They are automatically made available to the buyer on the home page of the VEGETAL SHOP website. It suffices for the buyer to click on "General Conditions of Sale" to know the conditions of his order, even before he has started the ordering process. Consequently, placing an order implies full and unreserved acceptance by the buyer of these C.G.V., to the exclusion of any other document such as prospectuses, catalogs issued by the seller and which have only an indicative value.

The fact that the seller does not take advantage at a given time of any of the provisions hereof cannot be interpreted as a waiver of the right to take advantage of any of the said conditions at a later date.

In the absence of a specific stipulation in these conditions and agreed in writing between the parties, orders are automatically subject to these general conditions of sale regardless of the clauses that may appear on the buyer's documents.

Our offers are exclusively reserved for private customers, excluding professional resellers.

The buyer declares to have read and accepted these General Conditions of Sale before placing his order. The validation of the order therefore implies acceptance of these General Conditions of Sale. These may be subject to modifications, the applicable conditions are those in force on our website on the date of placing the order.

The Customer must be at least 18 years old and have the legal capacity or hold parental authorization allowing him to place an order on the Site.

Article 2.a Terms of order and payment

Orders are only final when they have been confirmed by payment of the price by the buyer. Payment for products can be made by credit card, check or bank transfer. It intervenes in full as soon as the order is confirmed by the customer on the website.

An invoice will be established by VEGETAL SHOP and available in the "my account" section on the site. At the customer's request, an invoice may be sent to him by email, or to his billing address.

The beers remain the property of VEGETAL SHOP until full payment of the invoices, in accordance with the terms of law n ° 80 336 of May 1, 1980, relating to the retention of title, however the buyer becomes responsible for the articles upon delivery, the transfer of possession constitutes a transfer of risk.

All our offers are within the limits of available stocks without commitment and except sale in the meantime. In the event of a shortage on a product purchased and stipulated "in stock" on the site, VEGETAL SHOP undertakes to contact you within 48 hours to agree on a change or a partial or full refund of the order (at the convenience of the customer). Considering the rare or speculative nature of certain products, restrictions on the quantities available may be applied.

In such a case, the available quantity is limited per household (same name, same address, same email address, same account or credit card holder), VEGETAL SHOP therefore reserves the right to refuse an order in case of doubt. on the existence of a previous order for such a product. Article 2.b Order process

The Customer wishing to place an order on the Seller's Site must:

• create an account by providing the information requested on the Site: surname, first name, billing and delivery postal address, email address, telephone number.
• consult the product sheets and add the desired products to your basket
• validate the basket
• correct any typing errors
• validate the order
• choose and confirm your payment method

It is the Customer's responsibility to ensure the accuracy of the information provided, for which he is solely responsible.

The Seller will immediately communicate to the Customer by e-mail the confirmation of the registered order.

All the data provided and the recorded confirmation constitute proof of the transaction.

The Seller will archive orders and order confirmations on a reliable and durable medium constituting a faithful copy, in accordance with the provisions of article 1348 of the Civil Code.

The Customer may have access to all of his orders as follows: by consulting the “History of my orders” section in his “customer account”.

The Seller's computerized registers will be considered by the Parties as proof of communications, orders, payments and transactions between the Parties.

It is specified that the Seller has signed a distance selling contract with his bank. The banking transaction is secure and, in no way, the Seller keeps banking information on the Customer.

It is specified that the Seller reserves the right to refuse an order presenting an abnormal character, in particular with regard to the quantities ordered.

Finally, the non-professional Customer is informed and acknowledges that he cannot simultaneously order more than 110 liters of beer. This limitation does not apply to professional customers benefiting from the status of "registered operator" granted by French Customs.

Article 2.c Methods of payment

Bank card

Credit card payments are secured by the Crédit du Nord Group's "Webaffaires" online payment system and using the SSL protocol. In addition, all the banking information that you communicate to us, during your online purchase, is neither stored nor visible on the Internet. Bank transfer

The transfer must be sent to the Seller within 15 days.

In any event, if payment for the order has not reached the Seller within 15 days of the order, the order will be cancelled.

Article 3. Prices

Prices are expressed in Euros (€). Except sale and without commitment, subject to typographical and display errors. The prices differ according to the country of delivery in order to support the various administrative costs. The price indicated on the product sheet is indicated excluding transport costs. Shipping costs are invoiced according to the region of destination and the total weight of the bottles ordered, also including the weight of the packaging necessary for the proper protection of the bottles. The total amount due, indicated in the order confirmation by VEGETAL SHOP, is the final price to be paid, expressed all taxes included (French VAT and all other applicable taxes): this price includes the price of the products, handling costs, packaging and storage of products, administrative costs and transport costs. The VEGETAL SHOP company reserves the right to modify its selling prices at any time. All promotional operations (vouchers, reduction vouchers, partner reductions, etc.) are limited to the use of one person per household and per operation. VEGETAL SHOP reserves the right to refuse orders that do not correspond to this criterion. The delivery rates applicable during the order are available on the site.

Article 4.1 Terms of delivery in Metropolitan France

The online sale of the products presented on the Seller's site is limited and reserved for Customers residing in mainland Metropolitan France. Due to the operating regime granted to the Seller by French Customs, deliveries of products subject to specific taxes on alcohol (Excise) are not permitted outside this territory. Consequently, the following territories are excluded: Andorra, Monaco, DOM-TOM.

Deliveries are made to the address indicated by the Customer for this purpose when ordering, and once payment has been made.

Delivery will be made by our partner.

Article 4.2 Delivery and receipt

VEGETAL SHOP accepts the order and launches the delivery operations upon receipt of payment and the agreement of our verification department. The delivery of the items ordered is made to the buyer's home or to any other address indicated when ordering. The information provided by the buyer when taking the order commits him: in the event of an error in the wording of the recipient's contact details or incomplete information, the seller cannot be held responsible for the impossibility in which he could be to deliver the product.

In case of return of the goods for incomplete address, the buyer will be offered two alternatives:

• the reshipment of the goods after payment of the participation in the costs of return

Section 4.3 Verification

In the event of rejection of your file by our verification department, VEGETAL SHOP is entitled to require proof of identity and address from the buyer (as well as a K BIS extract if the buyer is a legal entity ). Article 4.4 Delivery times

VEGETAL SHOP undertakes to make every effort to deliver the products ordered as soon as possible, and as indicated on the site. The deadlines vary according to the availability of the product, the type of transport chosen, and the region of destination of the goods in continental Metropolitan France. If the buyer orders different products with different delivery times, the longest delivery time applies to the entire order. The delivery is made within the time provided by the direct delivery of the product to the announced recipient, or in the event of absence, by notice of availability. The delivery deadline will be specified in the order confirmation email.

If the delivery could not be ensured within this period, the consumer would be informed as soon as possible and could cancel his order and obtain the complete resolution of the sale. Delivery times run from the validation of the order, i.e. receipt of payment, bank authorization (online bank card) and the agreement given by the verification department. Article 4.5 Delivery costs

The delivery costs of the products are calculated according to the weight of the package. These are indicated prior to the validation of the order.

All beers sold by VEGETAL SHOP have had their duties paid to French customs. However, customs or import taxes may be requested upon the arrival of an order in its country of destination. It is the recipient's responsibility to pay the customs clearance costs, customs duties and other local taxes of the country of destination. VEGETAL SHOP having no control over these taxes, the recipient may not under any circumstances ask VEGETAL SHOP for any compensation or reimbursement related to the costs incurred in the country of destination.

Article 4.6 Transport and liability

The goods always travel at the recipient's risk and peril. It is therefore up to the buyer to check the contents of the package at the time of delivery and to formulate reservations if necessary, as follows: on the delivery slip provided by the carrier or by immediately calling the carrier's customer service , in the presence of the deliverer. Article 4.7 Complaints regarding delivery

Article 5. Out of stock

In case of out of stock of a product ordered and reported in stock on the website, VEGETAL SHOP will inform the customer as soon as possible and will offer him various alternatives:

• replacement with an equivalent product.
• reimbursement of unavailable products or the entire order according to the customer's choice.

In the case of a temporary shortage, the buyer will be offered to wait until the restocking date which will be specified to him. In the absence of acceptance, the customer may request the partial or complete cancellation of his order.

Article 6. Liability

The Seller may exonerate itself from all or part of its liability by providing proof that the non-performance or poor performance of the contract is attributable either to the Customer, or to the fact, unforeseeable and insurmountable, of a third party to the contract, or to a case of force majeure.

The Seller cannot be held responsible in the event of a computer bug occurring during his order, linked to the Customer's internet connection.

Article 7. Guarantee

All products supplied by the Seller benefit from the legal guarantee provided for in articles 1641 and following of the Civil Code.

In addition, the Customer also benefits from the guarantee of product conformity, provided for by articles L. 211-4 and following of the Consumer Code.

In the event of non-compliance of a product sold, the Customer will have the choice between repairing or replacing the product.

However, if the Customer's choice entails a manifestly disproportionate cost for the Seller, he may proceed according to the method of his choice.

If the repair and replacement of the product are impossible, the Customer may return the product and be reimbursed the price.

Reimbursement of the price is also possible if the solution requested by the Customer cannot be implemented within one month of the buyer's complaint.

In any case, the application of the guarantee for non-conformity of the product will take place at no cost to the Customer.

Article 8. Right of withdrawal

Pursuant to the provisions of article L.121-20 of the Consumer Code, the buyer has a period of 14 clear days from the delivery of his order to notify the seller of his withdrawal by email to contact@vegetal.shop. Subject to the perfect condition of the returned product, it will give rise to a refund equal to all the sums paid by the customer, i.e. the purchase price of the product(s) purchased and any delivery costs (minus surcharge for express delivery).

Return costs are the responsibility of the buyer. The goods travel at the risk and peril of the buyer. The return will be made by the carrier chosen by the buyer. The refund of the goods will be made by the seller within 30 days of receipt of the goods.

Article 9. Disputes

These general conditions of sale are subject to the application of French law. In the event of a dispute, the customer will first contact the company to obtain an amicable solution. Failing this, all conflicts arising from the execution of an order or the interpretation of these conditions and more generally of agreements of any kind concluded between the parties will fall within the jurisdiction of the court of our head office. In the event of non-payment, compensation of 10% of the amount of the invoice (minimum of 45 euros) will be requested, all without prejudice to damages for abusive resistance.

Article 12. Visuals and illustration of the products

The photos and illustrations used on the site are non-contractual. The images and photographs are the exclusive property of VEGETAL SHOP and are not free of rights.

The Customer is therefore prohibited from infringing the “VEGETAL SHOP” brand. It is strictly forbidden to use or reproduce the name of "VEGETAL SHOP", in any capacity whatsoever, and on any medium whatsoever, without the prior written consent of the Seller.

The establishment of hypertext links to the site www.vegetal.shop is authorized by the Seller.
